You actually may be able to. It would be up to the prosecutor. The forcing of bodily fluids on another person can be a pretty serious offense.

Good for you for following up.
Go all the way and build it up – include “mental distress/anguish.” Run to your Dr. and tell him you can’t sleep at night, it’s affecting your work, you ‘re highly anxious, etc., etc. because of that incident. Take that medical report to your lawyer.
I’m not saying “sue to get as much as you can”; I’m suggesting you do to send a message that “unprofessional conduct by taxi drivers will not be tolerated by the public-if so, they could be sued out of their jobs and houses. Be warned.”
Taxi driver has one nerve. Some of them better understand that If people didn’t hail/need cabs, AND give tips, they’d be out of business.

You don’t provide any information as to the circumstances surrounding the “assault”, were you in his cab or were you just walking past. Did you say something offensive or stupid, did you argue over the value of the fair.
I think it’s odd that every answer just states that you should sue the filthy bastard without knowing what caused the “assault”. Things like this are normally a two way street, you must have done or said something to provoke him.
I agree that spitting on someone is not only unacceptable, it is also degrading to both parties.
I would make sure my face was cleaned as soon as practical and then go to the doctor was soon as possible, explain what happened and discuss any tests etc that you should have to rule out any problems.
Life is difficult sometimes, but carrying on like a madman doesn’t make it better, get yourself checked out and get on with your life.

You can certainly request a blood test when you make your complaint. I know that if a person spits at a police officer they can be charged with assault (due to the various diseases that can be spread through spit). Definitely file the complain though and follow through on the subsequent paperwork, court filings, etc.
